This SMS Terms of Service ("SMS Terms") explains how Upswell ("Upswell," "we," "us," or "our") provides text messaging services to users of our apps, websites, and related services that provide restaurant engagement and cash-back rewards (collectively, the "Services"). By providing your mobile phone number and opting in to receive text messages from Upswell, you agree to these SMS Terms. If you do not agree, please do not opt in to our text messaging program.
By providing your mobile phone number and checking the opt-in box or otherwise indicating your consent, you expressly agree to receive automated marketing and transactional text messages from Upswell at the phone number you provided.
You may receive the following types of messages:
You do not have to agree to receive promotional text messages as a condition of purchasing any goods or services from Upswell.
Message frequency varies depending on your account activity and ongoing promotions. You may receive up to 10 messages per month.
Message and data rates may apply depending on your mobile service plan. Please consult your mobile carrier for information about your messaging plan and any applicable fees.
You may opt out of receiving text messages from Upswell at any time by:

After you opt out, you will receive one final confirmation message. Once opted out, you will no longer receive SMS messages from Upswell unless you opt in again.

Our text messaging service is available on all major U.S. carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, and U.S. Cellular. Carriers are not liable for delayed or undelivered messages.
We respect your privacy and handle your mobile phone number and related information in accordance with our Privacy Policy. By opting in to SMS messages, you acknowledge that you have read and understand our Privacy Policy.
We may update these SMS Terms from time to time. We will notify you of any material changes by posting the updated terms on our website and updating the "Last Updated" date. Your continued participation in our SMS program after changes are posted constitutes your acceptance of the updated terms.
We reserve the right to terminate our SMS messaging service or your participation in it at any time, with or without notice, for any reason, including violation of these SMS Terms.
